Remember that Labour Day is a public holiday in Ontario and most employees are entitled to the day-off with public holiday pay (calculated as the employee’s regular wages earned in the 4 workweeks before the public holiday, divided by 20).
If an employee is required to work on Labour Day, under Ontario’s Employment Standards Act, the employer and employee can agree in writing for the employee to work the public holiday. The employee is then entitled to receive either (a) public holiday pay plus premium pay for the hours worked on Labour Day (premium pay is 1½ times the employee’s regular rate of pay); or (b) regular pay on Labour Day, plus another day-off (called a “substitute” holiday) with public holiday pay.
