How to be Successful at an Employment Standards Inspection
Each year, the Ministry of Labour conducts proactive inspections of Ontario workplaces in order to increase compliance with the Employment Standards Act (the “ESA”). During these targeted inspections, an employment standards officer visits a workplace (sometimes without notice) and examines an organization’s records and employment practices.
Many employers believe that they are compliant with the ESA. However, a closer inspection may reveal that they have overlooked, misunderstood, or failed to comply with an important employment standards directive, resulting in significant fines and penalties.
From April 2014 to March 2015, the Ministry completed approximately 20,000 targeted inspections and investigations of workplaces, resulting in significant fines and penalties. Based on past statistics and compliance initiatives, the Ministry will inspect as many, if not more workplaces from April 2016 to March 2017.
